On November 3, 2025, the United States Supreme Court will hear argument in Winston Hencely v. Fluor Corporation. Army Specialist Hencely was grievously injured in a 2016 suicide bombing attack on Bagram Air Base in Afghanistan. The bomber worked on the base for private military contractor Fluor Corporation and constructed the bomb at his workstation. The United States Army concluded that Fluor’s failure to supervise its employee was the primary cause of the bombing. The United States District Court for South Carolina dismissed Hencely’s lawsuit against Fluor by finding that his claims were preempted by federal law. Firm partner Rob Snyder argued against that ruling in the District Court and on appeal to the Fourth Circuit Court of Appeals.
After the appellate ruling, Consovoy Mcarthy PLC joined Hencely’s legal team and along with Butler Prather, LLC, Bowen Painter, LLC, and Cannella Snyder LLC petitioned the Supreme Court to take the case, which it agreed to do earlier this year. Twenty state attorneys general, the VFW, the Center for Military Law and Policy, and other groups filed amicus curiae briefs supporting Specialist Hencely’s claims.
