The Georgia Senate has passed a significant tort reform bill, bringing Governor Brian Kemp’s top legislative priority one step closer to becoming law. While proponents claim the measure will lower insurance rates and create a fairer civil justice system, opponents, including leading plaintiffs’ attorneys, warn it poses a direct threat to the right to a jury trial in civil cases.
In a recent Law.com article, Rob Snyder voiced strong opposition to the legislation, calling it an “all-out attack on our constitutionally protected right to trial by jury in civil cases.”
Snyder challenged the bill’s underlying premise, stating:
“It is based on an incorrect belief that defendants are treated unfairly and that Georgia juries cannot fairly return verdicts based on the evidence.”
The proposed legislation introduces several controversial changes, including mandatory bifurcation of trials, restrictions on non-economic damages, and limitations on medical expense awards. Critics argue these measures will complicate litigation, prolong trials, and make it harder for injured individuals to receive fair compensation.
Snyder also addressed the bill’s claim that it will lead to lower insurance premiums, stating unequivocally that “there is absolutely zero evidence that any of the so-called reforms would reduce insurance premiums or that insurance premiums in this state are driven by lawsuits.”
By mandating separate trials for liability and damages, Snyder warned that the bill would “increase the complexity and length of every jury trial” and place a significant burden on courts, jurors, and victims. He highlighted the emotional toll this could take, particularly on grieving families and injured plaintiffs who would be forced to relive their trauma multiple times on the witness stand.
